1. Introduction

Once Tonight (“we,” “us,” or “our”) provides a personalized bedtime story subscription service that delivers custom AI-generated stories to families every night. These Terms of Service (“Terms”) govern your use of the Once Tonight website, application, and all related services.

By creating an account you agree to these Terms. If you do not agree, please do not use our service. You must be at least 18 years of age and a parent or legal guardian to create an account.

2. AI-Generated Content Disclaimer

Please read this section carefully. It describes the nature of AI-generated content and sets honest expectations for your experience with Once Tonight.

  • ●All stories delivered through Once Tonight are generated by artificial intelligence using Anthropic’s Claude model. Stories are created for entertainment and family enjoyment purposes only.
  • ●While we carefully design our prompts to produce age-appropriate, wholesome content for children aged 1 through 12, AI-generated content is inherently variable. Individual stories may occasionally contain unexpected themes, imperfect phrasing, or content that does not align perfectly with your family’s values or expectations.
  • ●We strongly encourage parents and guardians to read stories alongside their children and to use the resend and extra story features if a story does not feel right for any reason.
  • ●Stories generated by Once Tonight are not a substitute for professional educational materials, therapeutic content, or medical advice.
  • ●Once Tonight does not guarantee the specific content, themes, length, quality, or style of any individual story. Story output depends on AI technology that produces varying results.
  • ●The AI model does not retain memory of previous stories generated for your family. Each story is generated fresh without knowledge of prior stories.
  • ●We reserve the right to modify our story generation approach, prompts, age calibration, and content guidelines at any time to improve the service.

3. Eligibility and Account

  • ●You must be 18 years of age or older and a parent or legal guardian to create an account.
  • ●Once Tonight accounts are intended for one family unit.
  • ●You are responsible for maintaining the security of your account and password.
  • ●Please notify us immediately at support@oncetonight.com if you suspect unauthorized access to your account.
  • ●You are responsible for all activity that occurs under your account.

4. User Submitted Information and Story Generation

Once Tonight generates personalized bedtime stories based entirely on information you voluntarily provide including but not limited to your child’s name or nickname, age, physical appearance, interests, favorite things, family member names, and special occasions.

By providing this information you represent and warrant that:

  • ●You have the legal right to provide this information on behalf of the children in your care.
  • ●All information you provide is accurate to the best of your knowledge and you understand that story content is generated based on the details you submit.
  • ●You are solely responsible for the information you choose to provide and for ensuring it is appropriate for use in children’s stories.
  • ●You will not submit information that is false, misleading, offensive, or that you do not have the right to provide.

Once Tonight is not responsible for and expressly disclaims all liability for story content that results from inaccurate, incomplete, or inappropriate information provided by you. If you provide a nickname, made-up name, or fictional details for your child that is entirely your choice and Once Tonight bears no responsibility for the resulting story content.

Once Tonight does not verify the accuracy of any information you provide. We rely entirely on the good faith representations of our subscribers. If you believe any information stored in your account is incorrect you may update it at any time from your account settings.

Story content is generated by artificial intelligence based on the inputs you provide. While we have implemented content guidelines and prohibitions to ensure age-appropriate wholesome output we cannot guarantee that every combination of user-provided inputs will produce a result that meets every family’s individual standards and preferences. If a story does not meet your expectations you may request a replacement story at no additional cost using the extra story feature available in your account.

Once Tonight reserves the right to suspend or terminate accounts where we have reason to believe false or harmful information has been submitted with intent to generate inappropriate content.

5. Subscription and Billing

  • ●Once Tonight is offered as a subscription service with three plans: Solo at $9.99 per month, Family at $17.99 per month, and Legacy at $24.99 per month. Annual plans are available at a discount.
  • ●New subscribers receive a 5-day free trial. No charge is made during the trial period.
  • ●If you do not cancel before the trial ends, your subscription automatically converts to a paid plan on the trial end date.
  • ●Subscriptions are billed monthly or annually on the anniversary of your subscription start date.
  • ●Payment is processed securely through Stripe. Once Tonight does not store your payment card details.
  • ●We reserve the right to change subscription pricing with at least 30 days’ notice by email.
  • ●Discount codes may be applied at checkout and are subject to their individual terms and expiration dates.

Annual subscriptions are billed as a single upfront payment covering 12 months of service. Annual pricing represents a reduced per-month rate compared to monthly billing. No months are provided free of charge on annual plans. Subscribers who cancel an annual plan are eligible for a pro-rated refund of unused complete months as described in our Refund Policy.

6. Refund Policy

We want you to love Once Tonight. A brief summary of our refund policy:

  • ●72-hour money-back guarantee on any charge, no questions asked.
  • ●Monthly plans: no refund after 72 hours for the current billing period.
  • ●Annual plans: pro-rated refund for unused complete months after the first 30 days.

7. Subscription Pause and Cancellation

  • ●You may pause your subscription for 2 weeks, 1 month, 2 months, or 3 months from your account settings. No charge accrues during a pause period.
  • ●You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
  • ●Stories continue to be delivered until the end of the paid period.
  • ●Your story archive and account data are retained for 90 days after cancellation in case you choose to return.

8. Story Delivery

  • ●Once Tonight will generate and send a story to your designated email address every night at your chosen delivery time.
  • ●Story delivery depends on third-party email infrastructure. Once Tonight confirms delivery to the receiving mail server but cannot guarantee inbox placement due to factors outside our control, such as spam filters.
  • ●Every story is simultaneously saved to your story archive, accessible at any time from your dashboard.
  • ●The resend feature allows you to resend any story to your inbox at any time at no additional cost.

9. Intellectual Property

  • ●The Once Tonight brand, website design, logo, and all original content created by our team are protected by copyright and trademark laws.
  • ●Stories generated by Once Tonight are created by artificial intelligence using personalization data you provide. Once Tonight retains all intellectual property rights in the story generation system, prompts, and methodology. You are granted a personal, non-exclusive, non-transferable license to read, save, print, and share generated stories with your immediate family members for personal non-commercial purposes only. This license does not permit publishing, distributing, or commercializing generated stories in any form.
  • ●You may not reproduce, distribute, sell, or use AI-generated stories for commercial purposes.
  • ●You retain ownership of personal information you provide. By providing this information, you grant Once Tonight a limited license to use it solely for generating and delivering personalized stories to your family.

10. Prohibited Uses

You may not use Once Tonight to:

  • ●Violate any applicable laws or regulations.
  • ●Provide false information about your identity or your child’s age.
  • ●Attempt to reverse engineer or copy the story generation system.
  • ●Use the service for any commercial purpose.
  • ●Share account access with people outside your immediate family.

11. Account Termination

  • ●You may close your account at any time from your account settings or by contacting support@oncetonight.com.
  • ●We reserve the right to suspend or terminate accounts that violate these Terms.
  • ●Upon termination, your data is handled in accordance with our Privacy Policy.

12. Limitation of Liability

Once Tonight and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. The service is provided on an “as-is” and “as-available” basis.

Our total liability to you shall not exceed the amount you have paid to Once Tonight in the twelve months preceding the event giving rise to the claim.

13. Informal Dispute Resolution

Before initiating any formal legal proceedings against Once Tonight, you agree to first contact us at support@oncetonight.com and provide a written description of the dispute, the relief you are seeking, and your contact information. You agree to give Once Tonight 30 days from receipt of this notice to attempt to resolve the dispute informally. If the dispute cannot be resolved informally within 30 days, either party may pursue their available legal remedies.

14. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Iowa.

15. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated by email at least 14 days before taking effect. Your continued use of the service after changes constitutes acceptance of the updated Terms.
